Joshua James Dugas attended the Rockstar Energy Drink Mayhem Festival on July 29, 2015 at Lakewood Amphitheater in Atlanta. During Hellyeah's set, Dugas was struck in the back of the head with one of the skateboards given out by the anti-smoking group Truth and "became dazed and confused upon being hit in the head and went in and out of consciousness," according to the lawsuit reported in the Atlanta Journal-Constitution. The article states that Dugas was taken to the on-site medical tent, and then transported to the emergency room in an ambulance.
Dugas is now suing the city of Atlanta, Live Nation Entertainment, and the Truth Initiative Foundation for $40,000 due to "continuing and permanent injuries" that have caused him physical, emotional, and "economic" injuries. The suit states that Atlanta and Live Nation were in possession and control "of the premises on which plaintiff Dugas was attacked," and that Truth should not have been giving out items that could be used as weapons.
I've said it a million times before and I'll say it again here – hen you go into the pit, or any unruly crowd, you have certain expectations. Severe bodily harm and being attacked with any item or weapon is absolutely not one of those expectations, and it's kind of sad that stuff like this even happens. Hopefully it was an accident, but on the end of the concert itself, things that could be weapons probably shouldn't have been given out.
